Please read these Terms Of Service (the "Agreement") carefully. It sets out the terms under which our services (the "Service") are provided for you by Dancers4Dancers.com ("D4D"). By registering with Dancers4Dancers.com, you become a member (a "Member" or "Members") and agree to abide by these terms and conditions. Any Members not abiding by these terms and conditions will be banned, and all unused credits or
tokens will be confiscated, without any recourse for the Member.
By becoming a Member, you agree that:
- You will not include identifying information such as your
real name, phone number, email address, ICQ number, address or any contact
information in your Profile. If any such information is posted the Member will immediatly
be banned, and all unused credits or tokens will immediatly be confiscated, without any recourse.
- You will only use the Service in the manner that it was
designed to be used in, and in a manner that is accepted and legal according to all
applicable laws and regulations. If any attempt is made to use any services illegally,
or to defraud D4D, the Member will immediatly be banned, and all unused credits or
tokens will immediatly be confiscated, without any recourse. In addition the proper
authorities will be informed, and/or legal action will be taken.
- You will not transmit
chain letters, junk messages, advertisements or any type of solicitation whatsoever
of any products or services to any Members. You cannot use this website
for any commercial purpose whatsoever. Organizations, companies, and/or businesses
may not become Members.
- User identification on the Internet is difficult.
D4d cannot confirm that each Member is who he or she claims to be.
D4D hereby informs you that there can be risks involved in dealing with users
of the Internet, which may include people acting under
false pretence or with some unscrupulous intent. You must be
careful in dealing with other Members. You are solely responsible for
an contact, whether it be written, verbal or in person, with another Member.
- You agree that D4D reserves the right to change the content, presentation, performance, use of facilities or availability of any of its services, at its sole discretion, including these Terms of Service, with or without providing notice to you of such changes. Continued use of the Service or non-termination of your membership after changes are posted or notice is given to you, constitutes your acceptance or deemed acceptance of the terms as modified. So it is your responsibility to check these Terms Of Service regularly for any changes.
- By posting communications, you grant to D4D a royalty-free,
perpetual, irrevocable non-exclusive license to use, reproduce, edit, modify, publish,
translate, distribute, perform and display those communications alone or as part of
other works in any form, media or technology whether now known or hereafter developed
and sublicense such rights through multiple tiers of sublicensees.
D4D does not screen communications in advance and is not responsible for screening or monitoring material posted by Members. If notified by a Member of communications which allegedly do not conform to these Terms of Service, D4D
may investigate the allegation and determine in good faith and in its sole discretion whether to remove or request the removal of the communication. D4D has no liability or responsibility to Members for performance or non-performance of such activities.
D4D reserves the right to suspend, ban or terminate any Member, and
to removes all or part of a Profile for any reason
whatsoever at the sole discretion of D4D, including, but not limited to anyone
who violates these terms and conditions. D4D will have no liability to any Member
and each Member hereby explicitly waives all rights they may have against D4D in
respect of such conduct. Members explicity give D4D permission to change, edit or delete
any portion of their Profile that D4D deems to be offensive, or for any reason
whatsoever, at the sole discretion of D4D.
UNDER NO CIRCUMSTANCES WILL D4D BE RESPONSIBLE
FOR ANY LOSS OR DAMAGE RESULTING FROM YOUR USE OF THE SERVICE, A MEMBER'S
RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICE, OR TRANSMITTED
TO MEMBERS. D4D DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS,
OR USEFULNESS OF ANY INFORMATION ON THE SERVICE, AND NEITHER ADOPTS NOR ENDORSES
NOR IS RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR
STATEMENT MADE. THE SERVICE IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES
OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, IN ALL COMMUNICATION
WITH D4D, OR OTHERWISE WITH RESPECT TO THE SERVICE. D4D SPECIFICALLY DISCLAIMS
ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
OR NON-INFRINGEMENT. D4D DOES NOT WARRANT THAT A MEMBERS
USE OF THE SERVICE WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, OR
ERROR-FREE, OR WILL MEET THEIR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICE
WILL BE CORRECTED.
D4D DISCLAIMS ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS
OR OMISSIONS OF OTHER MEMBERS OR USERS (INCLUDING UNAUTHORIZED USERS, OR
"HACKERS") OF THE SITE OR SERVICE.
This User Agreement will be governed by and construed in
accordance with the laws of Ontario, Canada. All
Members irrevocably submit to the jurisdiction of
the courts of Ontario, Canada;
This Agreement sets out the entire understanding and agreement
between D4D and the Members.
